Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you (“you” or “User”) and Datject Infotech Private Limited  (“Datject,” “we,” “us,” or “our”), governing your access to and use of the website located at www.datject.com, together with any related applications, features, or services we offer (collectively, the “Service”).

By accessing or using the Service, creating an account, or clicking “I agree” where presented, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.

2. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice (such as an email or an in-app notification). Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

3. Eligibility

You must be at least 13 years old, or the age of legal majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Accounts & Registration

Some features of the Service may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at support@datject.com if you suspect any unauthorized use of your account.

5. Acceptable Use

You agree not to, and not to permit others to:

• Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law;
• Interfere with, disrupt, or place undue burden on the Service or the networks/servers connected to it, including via malware, bots, or automated scraping without permission;
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems;
• Upload or transmit content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable;
• Misrepresent your identity or affiliation with any person or entity;
• Use the Service to build a competing product or service without our written consent.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including suspending or terminating access.

6. User Content

“User Content” means any data, text, files, images, or other materials you submit, upload, or otherwise make available through the Service. You retain ownership of your User Content. By submitting User Content, you grant Datject a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely as necessary to operate, provide, and improve the Service.

You are solely responsible for your User Content and represent that you have all rights necessary to submit it and that it does not violate any third party’s rights or any applicable law.

7. Intellectual Property

The Service, including its design, text, graphics, logos, and underlying software, is owned by Datject or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights expressly granted to you in these Terms, we reserve all rights, title, and interest in the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless permitted by applicable law or with our prior written consent.

8. Fees & Payments

Pricing & Billing

Certain features of the Service require payment of fees (“Fees”). Applicable Fees will be displayed to you at the time of purchase or subscription. By providing a payment method, you authorize us (or our third-party payment processor) to charge that payment method for all Fees incurred in connection with your account.

Subscription & Auto-Renewal

Unless otherwise stated, paid plans are billed on a monthly or  annual recurring basis and will automatically renew at the end of each billing period at the then-current rate, until you cancel. You can cancel your subscription at any time through [your account settings / by emailing billing@datject.com]. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until then.

Price Changes

We may change our Fees at any time. If we change the Fees for a subscription you are actively enrolled in, we will provide notice before the change takes effect (for example, by email or in-app notice), and the new pricing will apply from your next billing cycle onward.

Failed Payments

If a payment fails or is declined, we may suspend or downgrade your access to paid features until a valid payment method is provided and outstanding Fees are paid.

Taxes

Fees are exclusive of applicable taxes, duties, and government charges unless otherwise stated. You are responsible for any such taxes associated with your purchase, other than taxes based on Datject’s net income.

9. Third-Party Services & Links

The Service may contain links to, or integrate with, third-party websites, products, or services that are not owned or controlled by Datject. We are not responsible for the content, policies, or practices of any third-party services. You access and use any third-party services at your own risk and subject to their respective terms.

10. Suspension & Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, created risk or possible legal exposure for us, or for any other reason at our discretion. You may stop using the Service and, where applicable, delete your account at any time.

Sections that by their nature should survive termination (including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DATJECT AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Datject and its officers, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

14. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Datject regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
